ข้อตกลงและเงื่อนไข
โปรดอ่านนโยบายความเป็นส่วนตัวนี้ ("นโยบาย") อย่างรอบคอบ เนื่องจากเป็นการทําสัญญาระหว่าง ท่าน ซึ่งไม่ว่าจะเป็นในนามของท่าน หรือในนามของนิติบุคคล (ต่อไปเรียกว่า "ท่าน") และบริษัท เวลลิออส จํากัด (ต่อไปเรียกว่า "เรา") ข้อตกลง และเงื่อนไขจะเกี่ยวกับการเข้าถึง และการใช้แอปพลิเคชันมือถือ SiPHPlayPoint (ต่อไปเรียกว่า "แอป") และรายละเอียดการใช้งานตามที่อ้างอิงในข้อกําหนด และเงื่อนไข (ต่อไปเรียกว่า "เงื่อนไขการใช้งาน") นโยบายนี้จะมีผลบังคับใช้ในกรณีที่เวลลิออส มีการรวบรวม, จัดเก็บ, ประมวลผล, แบ่งปัน, โยกย้ายสํารอง หรือถ่ายโอนข้อมูลของท่านทั้งหมดหรือบางส่วน (ต่อไปเรียกว่า "การใช้ข้อมูล")
เราใช้มาตรการทางเทคนิค และองค์กรที่เหมาะสม เพื่อปกป้องความปลอดภัย และการรักษาความลับของข้อมูลของท่าน มาตรการที่เราใช้ได้รับการออกแบบมา เพื่อให้ระดับความปลอดภัยที่เหมาะสมกับความเสี่ยงของการจัดเก็บข้อมูล, การประมวลผล, การสํารองข้อมูล หรือการย้ายข้อมูล ตามกฎหมายที่บังคับใช้
นโยบายนี้ใช้ไม่ได้กับเว็บไซต์ และบริการที่แสดง หรือเชื่อมโยงไปยังคําชี้แจงสิทธิ์ส่วนบุคคลอื่น เว็บไซต์ และบริการที่ร่วมตราสินค้ากับพันธมิตรรายอื่น อาจแสดง หรือเชื่อมโยงไปยังคําชี้แจงสิทธิส่วนบุคคลร่วมกัน หรือคําชี้แจงสิทธิ์ส่วนบุคคลแยกต่างหากของพันธมิตรของเรานอกเหนือจากนโยบายของเรา
1. ข้อมูลส่วนบุคคล
ข้อมูลส่วนบุคคล หมายถึง ข้อมูลส่วนตัวที่ระบุตัวตนของท่านได้ ไม่ว่าทางตรง หรือทางอ้อมในฐานะบุคคล ("ข้อมูลส่วนบุคคล") เพื่อวัตถุประสงค์ และเงื่อนไขที่กําหนดไว้ในนโยบายนี้ ข้อมูลส่วนบุคคลที่เรารวบรวมไว้อาจรวมถึง:
(1) ชื่อ ที่อยู่ หมายเลขโทรศัพท์ และที่อยู่อีเมล
(2) วันเกิด, เลขประจําตัวประชาชน หรือเลขที่หนังสือเดินทาง, เลขประจําตัวพนักงาน, วันที่เริ่มงาน;
(3) ข้อมูลอื่นๆ ที่สามารถระบุตัวตนของท่านได้ทั้งทางตรง และทางอ้อม
ข้อมูลส่วนบุคคลส่วนใหญ่จะถูกรวบรวมจากท่านเมื่อ
(ก) ท่านลงทะเบียนในแอป และเข้าในงานในแอป
(ข) ท่านขอความช่วยเหลือจากทีมสนับสนุนลูกค้าของเรา
(ค) ท่านทําแบบสํารวจ, สมัครรับจดหมายข่าว หรือขอข้อมูลอื่นจากเรา
(ง) ท่านเข้าร่วมในกิจกรรมที่เราอาจต้องการข้อมูลเกี่ยวกับท่าน
2. ข้อมูลที่เกี่ยวข้องกับแอป
เราอาจทำการรวบรวมข้อมูลบางอย่างของท่าน ที่ท่านได้เขียน, จัดเก็บ หรือส่งไปยังแอป หรือข้อมูลของท่านที่รวบรวมจากกิจกรรมต่างๆ และเกี่ยวข้องกับการใช้แอปของท่าน (เรียกรวมกันว่า "ข้อมูลที่เกี่ยวข้องกับแอป") เพื่อวัตถุประสงค์ และข้อกําหนดที่ระบุไว้ในนโยบาย นอกเหนือจากข้อมูลที่เกี่ยวข้องกับแอปแล้ว มีดังต่อไปนี้
(1) เมื่อท่านลงทะเบียนใช้งานแอป -ชื่อผู้ใช้, รหัสผ่าน, โทรศัพท์มือถือ, วันเกิด, เลขบัตรประจําตัวประชาชน หรือหนังสือเดินทาง, เลขประจําตัวพนักงาน, วันที่เริ่มงาน
(2) เมื่อท่านใช้งานในแอป – บันทึกกิจกรรมของท่าน, เวลาของการใช้งาน, ประเภทเบราว์เซอร์, ระบบปฏิบัติการที่ใช้, เวลาการเข้าถึงข้อมูล, ข้อมูลพิกัดสถานที่, ภาพถ่ายและไฟล์ และข้อมูลคุกกี้อื่นๆ
(3) เมื่อท่านกรอกโปรไฟล์ของท่านในแอป – ท่านสามรถใส่ข้อมูลโปรไฟล์ของท่านได้อย่างอิสระ ,รูปภาพ, ที่อยู่อีเมล, Line ID, Facebook
แม้ว่าข้อมูลเหล่านี้จะไม่ช่วยให้เราสามารถระบุตัวตนของท่านได้โดยตรง แต่เราอาจเก็บรวบรวมข้อมูลเพิ่มเติม หรือข้อมูลที่ไม่ระบุตัวตน ซึ่งไม่ได้ระบุตัวตนของท่านโดยตรง
3. วัตถุประสงค์การใช้ข้อมูล
ในส่วนที่เกี่ยวกับการใช้ข้อมูล เราอาจเก็บรวบรวม, ใช้งาน, จัดเก็บ, ประมวลผล, แบ่งปัน, ลดทอน, ประมวลผล, ถ่ายโอน หรือเปิดเผยข้อมูลส่วนบุคคล และข้อมูลที่เกี่ยวข้องกับแอปตามความจําเป็นในการดําเนินการในแอป เว้นแต่ท่านจะยินยอมให้มีวัตถุประสงค์เพิ่มเติมในการใช้ข้อมูลส่วนบุคคลของท่าน มิฉะนั้นวัตถุประสงค์ของการใช้ข้อมูลจะเป็นไปตามที่ระบุไว้ในที่นี้ (ต่อไปเรียกว่า "วัตถุประสงค์การใช้ข้อมุล")
3.1 ข้อมูลส่วนบุคคล
เราจะจำกัดการใช้ และเปิดเผยข้อมูลส่วนบุคคลตามความจําเป็นดังความต่อไปนี้:
- กรณีการสื่อสารกับท่าน – ผ่านทางโทรศัพท์, อีเมล, SMS หรือวิธีการอื่น
- กรณีส่งข่าวสาร และข้อมูลเหตุการณ์สําคัญ
- กรณีขอความคิดเห็น หรือการสํารวจข้อมูล เพื่อการการวิจัยทางตลาด และ/หรือการวิเคราะห์ทางสถิติ, การทําโปรไฟล์ หรือวัตถุประสงค์อื่น ซึ่งทำให้การตรวจสอบ, พัฒนา และปรับปรุงคุณภาพของแอปดียิ่งขึ้น และรวมถึงการทดสอบ ปรับปรุงระบบ และป้องกันการใช้แอปในทางที่ผิดหรือไม่เหมาะสม
3.2 ข้อมูลที่เกี่ยวข้องกับแอป
เราจะใช้ข้อมูลที่เกี่ยวข้องกับแอป เพื่อวัตถุประสงค์ดังต่อไปนี้:
- กิจกรรมในแอปที่ได้รับมอบหมายภารกิจให้ท่านทำ, การให้รางวัลกับท่าน หรือการสื่อสารกับท่าน
- การรวบรวมข้อมูลสถิติการใช้แอป เพื่อการปรับปรุง และเพิ่มประสิทธิภาพการใช้แอป
- การแก้ไข และตรวจสอบความเสี่ยงด้านความปลอดภัย, ข้อผิดพลาด, ปัญหา และการปรับปรุงที่จําเป็นในแอป
- ตรวจจับ และป้องกันการฉ้อโกง, ทำกิจกรรมต้องห้าม และการใช้แอปในทางที่ผิด
- การขอความคิดเห็น หรือการสํารวจข้อมูลการวิจัยทางการตลาด และ/หรือการวิเคราะห์ข้อมูล เพื่อวัตถุประสงค์ทางสถิติ, การทําโปรไฟล์ หรือวัตถุประสงค์อื่น ซึ่งทำให้การตรวจสอบ, พัฒนา และปรับปรุงคุณภาพของแอปดียิ่งขึ้น และรวมถึงการทดสอบ, ปรับปรุงระบบ และป้องกันการใช้แอปในทางที่ผิดหรือไม่เหมาะสม
4. การแชร์ข้อมูลกับบุคคลอื่นที่ผ่านการตรวจสอบแล้ว
4.1 เรามีการแบ่งปันข้อมูลส่วนบุคคล และข้อมูลที่เกี่ยวข้องกับแอปของท่าน ให้กับบริษัทในเครือของเรา และกับผู้ให้บริการอื่นที่ได้ผ่านการตวจสอบ และทำทำข้อตกลงกันไว้แล้ว เพื่อให้พวกเขาดำเนินการบางอย่างในนามของเรา เป็นการสนับสนุนความสามารถของแอปให้เกิดประโยชน์ในการใช้งานของท่าน ซึ่งอาจมีการดำเนินการต่อไปนี้:
(1) เปิดใช้งานบางแอปพลิเคชัน หรือเว็บเบราว์เซอร์ บนมือถือของท่าน
(2) การชําระเงินด้วยบัตรเครดิต หรือการชําระเงินบริการอื่น (ถ้ามีตามความประสงค์ของท่าน)
(3) ส่งเนื้อหาข้อมูล และสื่อสารกับท่าน (เช่น ส่งอีเมล หรือเปิดเว็บไซต์)
เราเพียงแบ่งปันข้อมูลดังกล่าวบนพื้นฐานที่จําเป็นต้องรู้ สําหรับบุคคลอื่น เพื่อการดําเนินงานในนามของเราเท่านั้น
เราอาจประมวลผล และแบ่งปันข้อมูลส่วนบุคคล และข้อมูลที่เกี่ยวข้องกับแอปของท่าน กับบุคคลอื่นที่ผ่านการตรวจสอบ ตามที่ท่านยอมรับ และอนุญาตให้เราแบ่งปัน และประมวลผลข้อมูลดังกล่าว เช่นนายจ้างของท่าน
บุคคลอื่นดังกล่าว จะถูกห้ามมิให้ใช้แบ่งปัน หรือเก็บข้อมูลส่วนบุคคลของท่าน เพื่อวัตถุประสงค์อื่นใด และมีสัญญาข้อกําหนดและเงื่อนไขที่เข้มงวด เพื่อคุ้มครองป้องกันข้อมูลส่วนบุคคล และข้อมูลที่เกี่ยวข้องกับแอปของท่าน
4.2 ท่านรับทราบและยอมรับว่าเราอาจแบ่งปันข้อมูลส่วนบุคคล และข้อมูลที่เกี่ยวข้องกับแอปของท่าน เพื่อการดังต่อไปนี้ :
(1) ปฏิบัติตามกฎหมาย หรือตอบสนองต่อคําขอที่ชอบด้วยกฎหมายหรือกระบวนการทางกฎหมาย;
(2) สำหรับการบังคับใช้เงื่อนไขการใช้งานตามกฎหมาย, นโยบายส่วนบุคคล หรือตามนโยบายอื่นที่เกี่ยวข้องกับแอป
(3) กระทําการตามความเชื่อโดยสุจริตว่าการเปิดเผยข้อมูลดังกล่าวเป็นสิ่งจําเป็น เพื่อปกป้องความปลอดภัยส่วนบุคคล หรือหลีกเลี่ยงการฝ่าฝืนกฎหมาย หรือระเบียบข้อบังคับ;
(4) การกระทำอื่นใดของท่าน ซึ่งเป็นกิจกรรมที่น่าสงสัยว่าอาจเป็นการฉ้อโกง, เป็นการละเมิด หรือกระทำผิดกฎหมาย ที่มีการร้องขอโดยหน่วยงานที่มีการบังคับใช้กฎหมาย ซึ่งสิทธิการพิจารณาเป็นไปตามดุลยพินิจของเราแต่เพียงผู้เดียว
5. การส่ง/การถ่ายโอนข้อมูล
เราอาจส่งข้อมูลของท่านออกนอกประเทศไทยตามความจำเป็น และการดำเนินการตามวัตถุประสงค์การใช้งาน ที่ได้อธิบายไว้ในนโยบายส่วนบุคคลนี้ เราอาจถ่ายโอนข้อมูลส่วนบุคคลของท่านเท่าที่จําเป็น ไปนอกประเทศไทยไปให้แหล่งเก็บข้อมูล และบริษัทอื่นในเครือของเรา และผู้ให้บริการอื่นของเรา ซึ่งเป็นส่วนหนึ่งในการดําเนินธุรกิจตามปกติของเรา เราจะตรวจสอบให้แน่ใจว่าข้อมูลส่วนบุคคลของท่านได้รับการคุ้มครองข้อมูลส่วนบุคคลไม่น้อยกว่ากฎหมายที่บังคับใช้ในประเทศไทย
6. การจัดการข้อมูล และความปลอดภัย
ท่านเข้าใจ และยอมรับ ว่าในวัตถุประสงค์การใช้ข้อมูล เราอาจจัดการข้อมูลส่วนบุคคล และข้อมูลที่เกี่ยวข้องกับแอปของท่านตามความจําเป็น รวมถึงการสํารองข้อมูล, ลบ, โยกย้าย, ถ่ายโอน, ประมวลผล หรือกิจกรรมอื่น เพื่อรักษาความปลอดภัย และรักษาความลับของข้อมูลดังกล่าว
เราปฏิบัติตามมาตรฐานที่ยอมรับโดยทั่วไป เพื่อรวบรวมจัดเก็บ และปกป้องข้อมูลส่วนบุคคล รวมถึงใช้การเข้ารหัส และขั้นตอนความปลอดภัย เช่นการควบคุมการเข้าถึงข้อมูล และบันทึกการเข้าถึงข้อมูล เราเก็บรักษาข้อมูลส่วนบุคคลไว้ตราบเท่าที่จําเป็นสําหรับการใช้แอปตามกฎหมายที่บังคับใช้ และเพื่อวัตถุประสงค์ทางกฎหมายและทางธุรกิจที่อาจมีขึ้นภายหลัง เหล่านี้อาจรวมถึงระยะเวลาการเก็บรักษา เช่น (a) การบังคับใช้ หรือภาระผูกพันทางกฎหมาย, สัญญา หรือการบังคับใช้อื่นที่คล้ายคลึงกัน (b) จากการแก้ไข, เก็บรักษา, บังคับใช้ หรือปกป้องสิทธิตามกฎหมาย และตามสัญญาระหว่างกัน (c) ตามความจำเป็นของบันทึกข้อมูลทางธุรกิจ และการเงินที่ครบถ้วนและถูกต้อง
7. สิทธิของท่าน
7.1 ท่านสามารถเข้าถึงดู และปรับปรุงข้อมูลส่วนบุคคลของท่านโดยการลงชื่อเข้าใช้บัญชีของท่าน และไปที่ "View Profile" หากท่านไม่สามารถเข้าถึง "View Profile" ไม่ว่าด้วยเหตุผลใดก็ตามท่านสามารถติดต่อเราตามรายละเอียดในส่วน "ติดต่อเรา" ด้านล่าง
7.2 ท่านอาจทําการร้องขอให้ลบข้อมูลส่วนบุคคลของท่าน คําขอนั้นจะได้รับการดำเนินการเฉพาะในขอบเขตข้อมูลที่ไม่จําเป็นสําหรับการใช้งานแอป และไม่เกี่ยวข้องกับการบังคับของกฎหมาย หรือเฉพาะข้อมูลที่ไม่จําเป็นสําหรับข้อกําหนดในการเก็บบันทึกทางธุรกิจทางกฎหมาย หรือตามสัญญาระหว่างเราอีกต่อไป
7.3 ท่านอาจขอให้เราส่งข้อมูลส่วนบุคคลของท่านโดยตรงถึงท่าน หรือถ่ายโอนไปยังผู้ควบคุมข้อมูลอื่น เท่าที่ระบบสามารถดำเนินการได้
7.4 ท่านอาจคัดค้าน หรือเพิกถอนความยินยอมของการใช้ข้อมูลได้ตลอดเวลา เว้นแต่ข้อมูลของท่านนั้นจะถูกจํากัดตามกฎหมายหรือสัญญาที่เป็นประโยชน์ต่อท่าน หรือข้อมูลส่วนบุคคลจะต้องเก็บไว้เพื่อตรวจสอบ หรือใช้ในการสุขอนามัย การวิจัยทางวิทยาศาสตร์หรือตามการปฏิบัติอื่นใดตามกฎหมายที่บังคับไว้
7.5 ท่านอาจร้องเรียนกับหน่วยงานกํากับดูแลการปกป้องข้อมูลที่รับผิดชอบ หากท่านเชื่อว่าการรวบรวมการใช้ หรือการเปิดเผยข้อมูลส่วนบุคคลของท่านละเมิดข้อกําหนดทางกฎหมายภายใต้กฎหมายที่บังคับใช้ในปัจจุบัน
8. การปรับเปลี่ยน
นโยบายนี้อาจได้รับการปรับปรุงเป็นครั้งคราว และด้วยเหตุผลใดก็ตาม เราจะแจ้งเตือนท่านเกี่ยวกับการเปลี่ยนแปลงใดๆ โดยการปรับปรุงข้อมูลที่ประกาศไว้ในเรื่อง นโยบายความเป็นส่วนตัว.

PRIVACY POLICY
AGREEMENT TO TERMS
Please read this Privacy Policy (“Policy") carefully as they form a contract between you, whether personally or on behalf of an entity (“you”), and Wellios Company Limited (“we”, “us” or “our”), concerning your access to and use of the SiPHPlayPoint, a mobile application (the “App”) as referenced in the Terms and Conditions available at Terms and Conditions (“T&C”). This Policy will apply where we or our company may collect, store, process, share, migrate, backup, or transfer your data in whole or in part (the “Data Using”).
We use appropriate technical and organizational measures to protect the security and confidentiality of your data. The measures we use are designed to provide a level of security appropriate to the risk of data storage, processing, backup, or migration in accordance with the applicable laws.
This Policy does not apply to websites and services that display or link to different privacy statements. Websites and services co-branded with other partners may display or link to a joint privacy statement or separate privacy statements of our partners in addition to our Policy.
1. PERSONAL DATA
Personal data means personal information which identifies you, either directly or indirectly, as an individual (the “Personal Information”) for the Purposes and terms set forth in this Policy. The Personal Information that we collect may include:
(1) Name, address, phone number, and e-mail address;
(2) Date of Birth, national ID or passport ID, employee ID, date of starting job;
(3) Other data that could directly or indirectly identify you.
Most of the Personal Information is collected from you when
(a) You register and sign up with the App;
(b) You request assistance from our customer support team;
(c) You complete our surveys, subscribe to newsletters, or request other information from us;
(d) You participate in activities where we may require information about you.
2. RELATED-APP DATA
We may collect your certain information that you write, submit, or transmit to the App or your data collected from activities of and related to your using of the App (collectively “Related-App Information”) for the Purposes and terms specified in the Policy. In addition to the Related-App Information are following:
(1) When you sign up with the App - your username, password, mobile phone, your birthday, national ID or passport ID, employee ID, starting date;
(2) When you use or interact with the App – your activities logs, time of interaction, browser type, operating system used, access time, location, photos and files and other cookie data;
(3) When you fill in your profile in the App – you freely fill in your profile information, your photo, address, email, Line ID, facebook ID
While none of this data will allow us to directly identify who you are, we may also collect additional data or anonymized data that does not directly identify you.
3. DATA USING PURPOSE
With respect to the Data Using, we may collect, use, store, process, share, mitigate, process, transfer, or disclose Personal Information and Related-App Information as necessary to perform the App, unless you have consented to further purpose of Data Using of your Personal Information otherwise the purpose of Data Using will be as specified herein (the “Purposes”).
3.1 Personal Information
We will use and disclose the Personal Information in following limited event as necessary:
(1) Communication event - with you telephone, email, SMS, or other methods;
(2) Publicize news and significant events
(3) Request feedback or participation in surveys, conduct market research and/or analysis for statistical, profiling, or other purposes for us to review, develop and improve the quality of the App, and test and improve our systems, and prevent the misuse or improper use of the App.
3.2 Related-App Information
We will use the Related-App Information for the purpose as follow:
(1) Activities in app assigned for your actions, give rewards to you or communicate with you;
(2) Collect statistics of using of the App to improve and optimize the performance of using of the App;
(3) Identify and investigate security risks, errors, problems, and needed enhancements to the App;
(4) Detect and prevent fraud, prohibited activities, and abuse of the App
(5) Request feedback or participation in surveys, conduct market research and/or analysis for statistical, profiling or other purposes for us to review, develop and improve the quality of the App, and test and improve our systems, and prevent the misuse or improper use of the App.
4. DATA SHARING WITH TRUSTED THIRD PARTY
4.1 With respected to the Purposes, we may share your Personal Information and Related-App Information with affiliated companies within our corporate family and with trusted third-party service providers in order for them to perform certain tasks on our behalf to support the feature of the App, that may include:
(1) activate some of their application or web browser on your mobile;
(2) processing credit card payments or other service payments (with your agreement);
(3) delivering content and communications to you (such as email or website);
We only share such information on need-to-know basis for the third party to perform the tasks on our behalf.
Otherwise, we may process and share your Personal Information and Related-App Information with other trusted third-party that you agree and permit us to share and process such information such as your employer.
These third parties are prohibited from using, sharing, or keeping your Personal Information for any other purpose, and are bound to strict terms and conditions to protect your Personal Information and Related-App Information.
4.2 You acknowledge and agree that we may also share your Personal Information and Related-App Information in order to:
(1) comply with the law or respond to lawful requests or legal process. ;
(2) using for law enforcement of these T&C, the Policy, or other policies associated with the App;
(3) act on a good faith belief that such disclosure is necessary to protect personal safety or avoid violation of applicable law or regulation;
(4) Further, at Our sole discretion, any suspected fraudulent, abusive, or illegal activity by you may be referred to law enforcement authorities.
5. DATA MITGATION/TRANSFER
We may transmit your information outside of Thailand in the manner and for the Purposes described in this Policy. We may transfer your Personal Information to the countries outside of Thailand to our parent and other affiliated companies and our third-party service providers as part of our normal business operations as necessary. We will ensure that your Personal Information will be not less than applicable laws of Thailand regarding personal data protection.
6. DATA MANAGEMENT AND SECURITY
With respect of the Purposes, you understand and agree that we may manage your Personal Information and Related-App Information as necessary including but not limited to, backup, delete, migrate, transfer, process, or otherwise activities for maintain the security and confidentiality of such information.
We follow generally accepted standards to collect, store and protect Personal Information, including the use of encryption and security procedures such as access control and access logs. We retain the Personal Information for as long as it is needed for using of the App, in accordance with the applicable laws, and thereafter for legal and business purposes. These may include retention periods such as (a) mandated by legal, contractual, or similar obligations; (b) for resolving, preserving, enforcing or defending our legal and contractual rights; (c) needed to maintain adequate and accurate business and financial records.
7. YOUR RIGHTS
7.1 You can access, view and update your Personal Information by signing into your account and visiting "View Profile". If you are unable to access "View Profile" for any reason, you may contact us as described in the "Contact Us" section below.
