ข้อตกลงและเงื่อนไขการใช้งาน SiPHPlayPoint
นิยาม:
“แอปพลิเคชัน” หมายถึง แอปพลิเคชัน SiPHPlayPoint และ/หรือแอปพลิเคชันอื่นใด ซึ่งเวลลิออสเป็นผู้ให้บริการ และ/หรือแอปพลิเคชันชื่ออื่นที่เวลลิออสเป็นผู้พัฒนาหรือปรับแต่ง (Customize) (ทั้งเวอร์ชันสำหรับคอมพิวเตอร์ (PC Version) และเวอร์ชันที่ให้บริการในโทรศัพท์มือถือ ตลอดจนอุปกรณ์อิเล็กทรอนิกส์อื่น (Mobile Version)
“บริการของเวลลิออส” หมายถึง แอปพลิเคชัน และเว็บไซต์ที่ได้ฝากเว็บไซต์ไว้ที่ระบบของเวลลิออส (Web Hosting) ซึ่งที่อยู่ของเว็บไซต์ (Web Address) ดังกล่าว อาจปรากฏ “.SiPHPlayPoint.co” เป็นส่วนหนึ่งของ URL หรือไม่ก็ได้
“เวลลิออส” หมายถึง บริษัท เวลลิออส จำกัด
“ผู้ให้บริการร่วม” หมายถึง บริษัท , แอปพลิเคชั่น , แพลทฟอร์ม หรือเว็บไซท์ ที่เชื่อมต่ออยู่กับระบบของเวลลิออสในการให้บริการกับผู้ใช้งาน
“ผู้ใช้งาน” หมายถึง ผู้ใช้บริการแอปพลิเคชัน และ/หรือบริการของเวลลิออส
“สังกัดของผู้ใช้งาน” หมายถึง บริษัท องค์กร หน่วยงาน ที่ผู้ใช้งานเป็นพนักงาน
“ข้อตกลงและเงื่อนไขการใช้งาน” หมายถึง ข้อตกลงและเงื่อนไขในการใช้งานแอปพลิเคชัน และบริการของเวลลิออส ซึ่งหมายความรวมถึงแต่ไม่จำกัดเฉพาะ แอปพลิเคชันที่ให้บริการในโทรศัพท์มือถือ แท็บเล็ต (Tablet) หรืออุปกรณ์อิเล็กทรอนิกส์อื่น และให้ใช้บังคับรวมถึงแอปพลิเคชัน และบริการของเวลลิออส ในส่วนที่ได้มีการเปลี่ยนแปลง ปรับปรุง อัพเดต หรือเพิ่มเติมโดยเวลลิออส ทั้งนี้เว้นแต่แอปพลิเคชัน หรือบริการของเวลลิออสดังกล่าวที่ได้มีการเปลี่ยนแปลง ปรับปรุง อัพเดต หรือเพิ่มเติมนั้นจะถูกกำหนดไว้โดยเฉพาะว่าให้อยู่ภายใต้ข้อตกลงและเงื่อนไขการใช้งานที่แตกต่างจากข้อตกลงและเงื่อนไขการใช้งานนี้
1. ข้อตกลงทั่วไป
ผู้ใช้งานรับทราบ และตกลงว่าข้อตกลง และเงื่อนไขการใช้งานนี้ มีขึ้นเพื่อบังคับใช้กับการใช้บริการของเวลลิออส รวมถึงการใช้สินค้าและบริการ การเข้าถึงและใช้เนื้อหา ฟีเจอร์ เทคโนโลยี หรือฟังก์ชันต่างๆ ในบริการของเวลลิออส ตลอดจนแอปพลิเคชัน และบริการที่เกี่ยวข้องกับการให้บริการของเวลลิออส และบริการอื่นที่เชื่อมโยงอยู่ ในแอปพลิเคชันนี้ ทั้งที่มีอยู่ในปัจจุบัน และที่เวลลิออสจะได้พัฒนาหรือจัดให้มีขึ้นในอนาคต เวลลิออสจึงขอให้ผู้ใช้งานโปรดอ่านและทำความเข้าใจรายละเอียดในข้อตกลง และเงื่อนไขการใช้งานนี้โดยละเอียด ก่อนกดปุ่ม ‘ตกลง’ ยอมรับข้อตกลงและเงื่อนไขการใช้งานนี้
2. การใช้แอปพลิเคชันและทรัพย์สินทางปัญญา
2.1 ผู้ใช้งานรับทราบและตกลงจะปฏิบัติตามกฎหมาย หลักเกณฑ์ และระเบียบต่าง ๆ ที่เกี่ยวข้อง ทั้งที่มีผลใช้บังคับในปัจจุบัน และที่จะมีการแก้ไขหรือเพิ่มเติมในอนาคต ตลอดจนข้อตกลงและเงื่อนไขการใช้งาน นโยบาย การให้บริการของเวลลิออสทั้งที่กำหนดไว้เป็นการทั่วไปและที่ได้กำหนดไว้โดยเฉพาะเจาะจงในส่วนใดส่วนหนึ่งของแอปพลิเคชันนี้ และที่ได้กำหนดไว้ในเว็บไซต์ที่ได้ฝากเว็บไซต์ไว้ที่ระบบของเรา (ถ้ามี) ทั้งหมด (ซึ่งต่อไปนี้จะเรียกรวมกันและให้ถือเป็นส่วนหนึ่งของ “ข้อตกลงและเงื่อนไขการใช้งาน”) ทั้งนี้ ผู้ใช้งานรับทราบและตกลงว่าข้อตกลงและเงื่อนไขการใช้งานทั้งหมดที่กำหนดไว้นั้นอาจมีการเปลี่ยนแปลงได้เพื่อให้สอดคล้องกับแนวทางการให้บริการและหลักเกณฑ์ของกฎหมายที่มีการเปลี่ยนแปลงไป โดยอาจไม่ได้แจ้งหรือบอกกล่าวให้ผู้ใช้งานทราบล่วงหน้า ดังนั้น ผู้ใช้งานจึงควรติดตามข้อตกลงและเงื่อนไขการใช้งานเหล่านี้อยู่เสมอ อย่างไรก็ดี เวลลิออสอาจดำเนินการตามที่เห็นสมควร เพื่อเผยแพร่การเปลี่ยนแปลงข้อตกลงและเงื่อนไขการใช้งานภายหลังการเข้าสู่แอปพลิเคชันนี้หรือบริการของเวลลิออส และในกรณีที่มีการเปลี่ยนแปลงในสาระสำคัญ เราจะดำเนินการอย่างเต็มที่เพื่อแจ้งให้ผู้ใช้งานทราบ และเพื่ออำนวยความสะดวกให้แก่ท่านในฐานะผู้ใช้งานรายเดิม เมื่อผู้ใช้งานได้เข้าใช้งานแอปพลิเคชันนี้และ/หรือบริการของเวลลิออสภายหลังการเปลี่ยนแปลงดังกล่าวแล้ว ย่อมถือว่าผู้ใช้งานตกลงยอมรับข้อตกลงและเงื่อนไขการใช้งานทั้งหมดตามที่ได้เปลี่ยนแปลงแล้ว ทั้งนี้หากผู้ใช้งานไม่เห็นด้วยกับการดำเนินการตามวรรคก่อน รวมถึงรายละเอียดต่างๆ ที่ปรากฏในข้อตกลงและเงื่อนไขการใช้งานนี้ ผู้ใช้งานสามารถยุติการใช้งาน และขอให้เวลลิออส ลบข้อมูลที่เกี่ยวกับผู้ใช้งาน หรือดำเนินการเพื่อใช้สิทธิอื่นใดในฐานะเจ้าของข้อมูลส่วนบุคคลได้ ภายใต้หลักเกณฑ์ของกฎหมาย และที่กำหนดในนโยบายคุ้มครองข้อมูลส่วนบุคคล (Privacy Policy) โดยผู้ใช้งานสามารถศึกษาข้อมูลเพิ่มเติมได้จาก ”Privacy Policy” ซึ่งถือเป็นส่วนหนึ่งของข้อตกลงและเงื่อนไขการใช้งานนี้
2.2 ผู้ใช้งานยอมรับและตกลงว่า การใช้บริการของเวลลิออสจะต้องมีการใช้บริการอินเทอร์เน็ต เครือข่ายโทรศัพท์มือถือ อุปกรณ์ ซอฟต์แวร์ แพลตฟอร์ม (Platform) และ/หรือบริการอื่นใดที่เกี่ยวข้องจากผู้ให้บริการธุรกิจดังกล่าว ซึ่งผู้ใช้งานจะต้องจัดหาเพื่อให้ผู้ใช้งานสามารถติดตั้ง เข้าถึง และใช้บริการของเวลลิออสและ/หรือเนื้อหาได้ ด้วยค่าใช้จ่ายของผู้ใช้งานเองทั้งสิ้น และการใช้บริการดังกล่าวผู้ใช้งานมีหน้าที่ต้องปฏิบัติตามข้อตกลงต่าง ๆ ของผู้ให้บริการดังกล่าวด้วย ทั้งนี้การเข้าถึงและใช้บริการของเวลลิออส จึงอาจมีปัจจัยอื่น ๆ ที่นอกเหนือการควบคุมของเวลลิออส ซึ่งมีผลกระทบต่อคุณภาพและความพร้อมใช้งานของแอปพลิเคชันและ/หรือบริการของเวลลิออส เวลลิออสจึงไม่สามารถการันตีคุณภาพการใช้งานได้
2.3 เวลลิออสสงวนสิทธิที่จะเปลี่ยนแปลง หรือยกเลิกการให้บริการแอปพลิเคชันดังกล่าวไม่ว่าทั้งหมดหรือบางส่วน รวมถึงอาจพิจารณาเรียกเก็บค่าใช้จ่ายสำหรับการใช้แอปพลิเคชันนี้ไม่ว่ากรณีใดในอนาคต โดยจะมีการแจ้งในระบบให้ทราบล่วงหน้า
2.4 บรรดาข้อมูลที่ปรากฏในบริการของเวลลิออส ซึ่งรวมถึงแต่ไม่จำกัดเฉพาะ ข้อความ รูปภาพ วีดีโอ ตารางข้อมูล กราฟ เครื่องหมายการค้า กราฟิก เสียง การออกแบบหน้าจอแอปพลิเคชัน การออกแบบส่วนต่อประสานกับผู้ใช้ (Interface) ข้อมูลต่าง ๆ ไม่ว่าจะอยู่ในรูปแบบใด โปรแกรมซอฟต์แวร์ใด ๆ ที่มีอยู่ในแอปพลิเคชันนี้ รวมถึงข้อมูลทั้งหลายที่ผู้ใช้งานได้ดาวน์โหลดจากแอปพลิเคชันนี้ (ถ้ามี) (ซึ่งต่อไปนี้จะรวมเรียกว่า “เนื้อหา”) ถือเป็นสิทธิของเวลลิออส หรือผู้ให้อนุญาตแก่เวลลิออส (แล้วแต่กรณี) ซึ่งเนื้อหาเหล่านั้นได้รับความคุ้มครองด้านทรัพย์สินทางปัญญา และ/หรือสิทธิในความเป็นเจ้าของอื่น ๆ ตามกฎหมายของประเทศไทยและ/หรือกฎหมายของประเทศอื่นไม่ว่าในรูปแบบใด ๆ และไม่ว่าจะได้รับการจดทะเบียนไว้แล้วหรือไม่ก็ตาม ทั้งนี้ การนำชื่อทางการค้า เครื่องหมายการค้า เครื่องหมายบริการ และเครื่องหมายอื่น ๆ ของเวลลิออส รวมถึงทรัพย์สินทางปัญญาใด ๆ ที่ปรากฏในแอปพลิเคชันนี้ไปใช้ ไม่ว่าจะด้วยวัตถุประสงค์ใด ๆ ผู้ใช้งานจะต้องได้รับความยินยอมล่วงหน้าเป็นลายลักษณ์อักษรจากเวลลิออสก่อนดำเนินการ
2.5 บรรดาชื่อทางการค้า ชื่อสินค้า เครื่องหมายการค้า เครื่องหมายบริการ และเครื่องหมายอื่น ๆ รวมถึงทรัพย์สินทางปัญญาอื่นใดที่ปรากฏในแอปพลิเคชันนี้ นอกเหนือจากสิ่งที่เป็นทรัพย์สินทางปัญญาของเวลลิออสซึ่งได้ถูกนำมาเรียบเรียงหรือจัดให้มีขึ้นเพื่อใช้เป็นส่วนประกอบของบริการของเวลลิออส มีขึ้นเพื่อวัตถุประสงค์ในการตกแต่งรูปลักษณ์ของการใช้บริการ โดยเวลลิออสในฐานะผู้ให้บริการแอปพลิเคชันไม่ได้มีเจตนาที่จะกระทำการใด ๆ อันเป็นการละเมิดสิทธิในทางการค้าหรือทรัพย์สินทางปัญญาของผู้ใด
2.6 เว้นแต่มีข้อความระบุไว้เป็นอย่างอื่นในบริการของเวลลิออสบรรดาเนื้อหา ไฟล์ หรือเอกสารที่ปรากฏในแอปพลิเคชันนี้และ/หรือบริการของเวลลิออสอื่นๆ ที่เกี่ยวข้อง ผู้ใช้งานมีสิทธิเพียงเข้าดู ดาวน์โหลด อัพโหลดเนื้อหา และพิมพ์เนื้อหาดังกล่าว เฉพาะเพื่อประโยชน์แก่การใช้งานในทางส่วนตัว และต้องไม่ใช่การใช้งานที่เป็นไปเพื่อประโยชน์ในทางการค้า และผู้ใช้งานตกลงไม่ทำสำเนา หรือจัดเก็บ หรือดาวน์โหลดเนื้อหาไม่ว่าจะในรูปของเอกสารหรือในรูปแบบสื่ออิเล็กทรอนิกส์อื่นใดอันมีวัตถุประสงค์เพื่อการส่ง โอน จัดทำ เผยแพร่ พิมพ์ ทำซ้ำ ดัดแปลง สร้างงานที่พัฒนา นำออกแสดง แพร่กระจาย จำหน่าย ให้สิทธิ เช่า ให้เช่า หรือโอนเนื้อหาใด ๆ ให้แก่บุคคลภายนอก ไม่ว่าการกระทำดังกล่าวจะเป็นไปเพื่อประโยชน์ในทางการค้าหรือได้รับประโยชน์เป็นสิ่งตอบแทนอื่นใดหรือไม่ก็ตาม เว้นแต่จะได้รับความยินยอมเป็นลายลักษณ์อักษรล่วงหน้าจากเวลลิออสก่อนดำเนินการ
3. ข้อสงวนสิทธิ์และข้อจำกัดความรับผิด
3.1 บริการของเวลลิออสมีขึ้นเพื่อเผยแพร่ ให้ข้อมูล และเป็นเครื่องมืออำนวยความสะดวกเข้าถึงบริการของผู้ให้บริการร่วมเท่านั้น เวลลิออสมิได้ชี้นำ หรือให้ความคิดเห็น รวมทั้งไม่ได้ให้คำแนะนำเกี่ยวกับการซื้อ ขาย แลกเปลี่ยน สับเปลี่ยน การลงทุน หรือการทำธุรกรรมใดๆ เกี่ยวกับการให้บริการของผู้ให้บริการร่วม ที่ปรากฏในแอปพลิเคชันนี้ นอกจากนี้ การให้บริการของเวลลิออสไม่ว่าในรูปแบบใดๆ ไม่ก่อให้เกิดความผูกพันในลักษณะที่เป็นตัวแทนของผู้ใช้งาน และไม่ให้ถือว่ามีความเกี่ยวข้องกับการทำธุรกรรมใด ๆ ระหว่างผู้ใช้งานกับผู้ให้บริการแก่ผู้ใช้งานที่เกิดขึ้นโดยตรงหรือเป็นผลสืบเนื่องมาจากการเข้าใช้งานแอปพลิเคชันนี้และ/หรือบริการของเวลลิออสแต่อย่างใด ในการตัดสินใจ ผู้ใช้งานควรศึกษาข้อมูลเพิ่มเติมเกี่ยวกับรายละเอียดการให้บริการ การชำระค่าบริการ และผลิตภัณฑ์ต่างๆของผู้ให้บริการร่วม รวมถึงข้อตกลงและเงื่อนไขการใช้งาน ตลอดจนระเบียบต่าง ๆ ที่เกี่ยวข้องในการเข้าใช้บริการของเวลลิออส
3.2 เนื้อหาและข้อมูลที่แสดงหรือปรากฏในแอปพลิเคชัน และ/หรือบริการของเวลลิออส ถูกนำเสนอตามสภาพของเนื้อหาและข้อมูลที่ได้รับมาจากผู้ให้บริการร่วม เวลลิออสไม่อาจรับรองหรือรับประกันใด ๆ ไม่ว่าทางตรงหรือทางอ้อม ไม่ว่าจะเป็นการรับประกันด้านความครบถ้วน ถูกต้องเหมาะสม ความเป็นปัจจุบัน หรือความน่าเชื่อถือของเนื้อหาและข้อมูล หรือการรับประกันผลที่จะได้รับจากการใช้เนื้อหาหรือเข้าถึงบริการของเวลลิออส รวมถึงความเหมาะสมในการใช้งาน และเวลลิออสไม่ต้องรับผิดชอบในความสูญหาย หรือความเสียหายใดที่เกิดจากการใช้แอปพลิเคชัน และ/หรือจากการนำเนื้อหาข้อมูลที่ปรากฏในบริการของเวลลิออสไปใช้ในทุกกรณี
3.3 เวลลิออสจะดำเนินการอย่างเหมาะสมเพื่อให้การเข้าถึง และการใช้งานแอปพลิเคชันนี้เป็นไปอย่างต่อเนื่อง ไม่หยุดชะงัก และจะจัดให้มีระบบป้องกันการเข้าถึงข้อมูลใด ๆ จากบุคคลที่ไม่ใช่ผู้ใช้งาน อย่างไรก็ดี เวลลิออสไม่อาจรับรองได้ว่าการเข้าถึงบริการของเวลลิออสจะเป็นไปโดยปราศจากความล่าช้าและข้อผิดพลาดใด ๆ และไม่อาจรับรองว่าบริการของเวลลิออสจะปราศจากโปรแกรม ไฟล์ หรือซอฟต์แวร์ที่มีจุดประสงค์มุ่งร้าย หรืออาจสร้างความเสียหายต่อระบบหรือข้อมูลในระบบของผู้ใช้งาน อาทิ ไวรัส คอมพิวเตอร์เวิร์ม โทรจันฮอร์ส สปายแวร์ หรือไฟล์ซึ่งเป็นอันตรายอื่น ๆ (รวมเรียกว่า “ความบกพร่อง”) ทั้งนี้ ไม่ว่าความบกพร่องดังกล่าวจะเกิดขึ้นจากบุคคล หรือความขัดข้องทางเทคนิค หรือเหตุสุดวิสัยอย่างอื่น ดังนั้น ผู้ใช้งานจึงรับทราบเงื่อนไขดังกล่าวและตกลงว่าในกรณีที่มีความบกพร่องใด ๆ เกิดขึ้น เวลลิออสจะไม่รับผิดชอบในความสูญหาย ความเสียหาย ค่าสินไหมทดแทน ค่าใช้จ่าย หรือค่าเสียหายใด ๆ ที่เกิดจากหรือเป็นผลสืบเนื่องมาจากความบกพร่องเหล่านั้นในทุกกรณี
3.4 เวลลิออสสงวนสิทธิ์ในการพิจารณาไม่อนุญาตให้ผู้ใช้งานใช้งานแอปพลิเคชันนี้ รวมถึงสงวนสิทธิ์ในการเปลี่ยนแปลง หรือระงับการเข้าถึงบริการของเวลลิออสไม่ว่าบางส่วนหรือทั้งหมดและไม่ว่าในเวลาใด ๆ แก่ผู้ใช้งาน โดยไม่จำเป็นต้องบอกกล่าวล่วงหน้าหรือระบุเหตุผลในการดำเนินการนั้น
3.5 เวลลิออสไม่อาจรับรองว่าบรรดาโฆษณาที่อยู่บนแอปพลิเคชันนี้และ/หรือบริการของเวลลิออส(ถ้ามี) มีความถูกต้อง สมบูรณ์ และปราศจากข้อบกพร่องใด ๆ โดยเวลลิออสเป็นเพียงสื่อกลางในการส่งผ่านข้อมูลการโฆษณาเท่านั้น และไม่ใช่ตัวแทน หุ้นส่วน หรือมีนิติสัมพันธ์ใด ๆ กับเจ้าของโฆษณาซึ่งปรากฏอยู่บนบริการของเวลลิออสตลอดจนไม่สามารถตรวจสอบ หรือทราบถึงแหล่งที่มาและ/หรือรายละเอียดของโฆษณาทั้งหมดที่ปรากฏในบริการของเวลลิออสได้ ทั้งนี้ หากการนำเสนอโฆษณาดังกล่าวก่อให้เกิดความสูญหายหรือความเสียหายแก่ผู้ใช้งาน เวลลิออสจึงไม่อาจรับผิดชอบในความสูญหายหรือความเสียหายที่เกิดขึ้นแก่ผู้ใช้งานอันเนื่องมาจากการเชื่อถือหรือยินยอมปฏิบัติตามโฆษณาดังกล่าวและขอปฏิเสธความรับผิดและภาระผูกพันทางกฎหมายทุกกรณี
3.6 นอกเหนือจากที่กำหนดไว้ในข้อตกลงและเงื่อนไขการใช้งานนี้ เวลลิออส กรรมการ ผู้จัดการ ผู้บริหาร พนักงาน ลูกจ้าง ตัวแทน หรือที่ปรึกษาของเวลลิออส จะไม่รับผิดในความผิดพลาด หรือความบกพร่องใดจากบริการของเวลลิออส หรือจากข้อมูล เนื้อหาที่ปรากฏในบริการของเวลลิออสตลอดจนไม่รับผิดในผลของการกระทำ หรือละเว้นการกระทำใดที่เกี่ยวข้องกับบริการของเวลลิออสไม่ว่าจะเกิดจากสัญญา ละเมิด ประมาท หรือเหตุอื่นใดที่อาจจะเกิดขึ้น ถึงแม้ว่าเวลลิออสจะได้รับแจ้งว่าอาจจะเกิดความเสียหายดังกล่าวขึ้นก็ตาม ทั้งนี้ เว้นแต่ กรณีที่ความเสียหายนั้นเกิดขึ้นจากความจงใจหรือประมาทเลินเล่ออย่างร้ายแรงของเวลลิออส
4. การเชื่อมโยงข้อมูล และเว็บไซต์
แอปพลิเคชันนี้อาจมีการเชื่อมโยงกับฟังก์ชัน (Functions) ฟีเจอร์ (Features) หรือแพลทฟอร์ม หรือเว็บไซต์อื่นๆ รวมถึงผลิตภัณฑ์ และบริการของบุคคลภายนอก (“เว็บไซต์ที่เชื่อมโยง”) การเชื่อมโยงนี้มีขึ้นเพื่ออำนวยความสะดวกแก่ผู้ใช้งานเท่านั้น โดยเว็บไซต์ที่เชื่อมโยงนี้มิได้แสดงว่าได้รับการสนับสนุน หรืออยู่ภายใต้การควบคุม หรือความรับผิดชอบของเวลลิออสดังนั้น เวลลิออสจึงไม่อาจให้การรับรองในความถูกต้อง ความน่าเชื่อถือ หรือความปลอดภัยของเว็บไซต์ที่เชื่อมโยง และจะไม่มีความรับผิดในความสูญหายหรือเสียหายใด ๆ ที่ผู้ใช้งานได้รับจากการใช้งานหรือเชื่อมโยงเว็บไซต์ดังกล่าว และขอให้ผู้ใช้งานโปรดศึกษาข้อตกลงต่าง ๆ และเงื่อนไขการใช้งานของเว็บไซต์ที่เชื่อมโยงนั้น
5. ข้อตกลงการใช้งานเฉพาะส่วน
ผู้ใช้งานรับทราบและตกลงว่า เวลลิออสมีสิทธิในการลบกระทู้ หัวข้อสนทนา ข้อความ หรือระงับสิทธิการใช้งานกระดานสนทนา ของผู้ใช้งาน (ถ้ามี) ไม่ว่าทั้งหมดหรือบางส่วน ได้ตามที่เวลลิออสพิจารณาเห็นสมควร โดยไม่จำเป็นต้องแจ้งหรือชี้แจงเหตุผลให้ผู้ใช้งานทราบไม่ว่ากรณีใด ๆ
6. นโยบายคุ้มครองข้อมูลส่วนบุคคล
ผู้ใช้งานรับทราบและตกลงว่า การเก็บรวบรวม ใช้ และเปิดเผยข้อมูลส่วนบุคคลของผู้ใช้งานโดยเวลลิออสสำหรับการใช้งานแอปพลิเคชันนี้และ/หรือบริการของเวลลิออสได้รับความคุ้มครองภายใต้นโยบายคุ้มครองข้อมูลส่วนบุคคล (Privacy Policy) โดยผู้ใช้งานสามารถศึกษาข้อมูลเพิ่มเติมได้จากนโยบายคุ้มครองข้อมูลส่วนบุคคล (Privacy Policy) ซึ่งระบุต่อจากข้อตกลงและเงื่อนไขการใช้งานนี้
7. นโยบายการรักษาความมั่นคงปลอดภัยของแอปพลิเคชัน
เวลลิออสได้เลือกใช้เทคโนโลยี มาตรการรักษาความมั่นคงปลอดภัยในการทำธุรกรรมบนเครือข่ายอินเทอร์เน็ต เพื่อป้องกันข้อมูลของผู้ใช้งานในระหว่างการส่งข้อมูลผ่านเครือข่ายการสื่อสาร หรือจากการถูกโจรกรรมข้อมูลโดยบุคคลหรือเครือข่ายอื่นทุกระบบที่ไม่ได้รับอนุญาตเข้ามาเชื่อมต่อกับเครือข่ายของเวลลิออส เช่น Firewall และการเข้ารหัสแบบ Transport Layer Security (TLS) เป็นต้น
8. รหัสประจำตัว (Username) และรหัสผ่าน (Password)
8.1 เว้นแต่ในกรณีที่ผู้ใช้งานได้รับรหัสประจำตัว (Username) รหัสผ่าน (Password) และรหัสลับ (PIN) สำหรับการใช้งานแอปพลิเคชัน ในการใช้งานแอปพลิเคชัน ผู้ใช้งานจะต้องมีสถานภาพเป็นพนักงานในสังกัดของผู้ใช้งาน หรือเป็นผู้ที่อยู่ในสังกัดของผู้ใช้งาน อนุญาติให้ใช้งานได้ ซึ่งสังกัดของผู้ใช้งานจะเป็นผู้ออก ทั้งรหัสประจำตัว (Username) รหัสผ่าน (Password) และรหัสลับ (PIN) (ถ้ามี) ให้กับผู้ใช้งาน โดยผู้ใช้งานจะต้องเก็บรักษารหัสประจำตัวและรหัสผ่านของตนเองไว้เป็นความลับ การเข้าใช้งานและทำรายการใด ๆ ที่เกิดขึ้นจากการเข้าสู่ระบบ (Login) ด้วยรหัสประจำตัวและรหัสผ่านของผู้ใช้งานในแอปพลิเคชันนี้ให้ถือว่าการกระทำดังกล่าวถูกต้องสมบูรณ์และเป็นการกระทำของผู้ใช้งานเอง หากมีความเสียหายใด ๆ เกิดขึ้น ไม่ว่าจะด้วยเหตุใดก็ตาม ผู้ใช้งานจะต้องรับผิดชอบในการกระทำดังกล่าวทุกประการ และผู้ใช้งานตกลงจะไม่โต้แย้งหรือเรียกร้องให้เวลลิออสรับผิดชอบชดใช้ค่าเสียหายแทนผู้ใช้งานทุกกรณี
8.2 ผู้ใช้งานรับทราบและตกลงว่า ผู้ใช้งานสามารถ เปลี่ยนแปลง ระงับ หรือยกเลิกรหัสประจำตัว รหัสผ่าน หรือรหัสลับของผู้ใช้งาน และ/หรือการใช้บริการแอปพลิเคชันนี้ได้ตลอดเวลาด้วยตนเองผ่านช่องทางต่าง ๆ ตามเงื่อนไขและวิธีการที่สังกัดของผู้ใช้งานเป็นผู้กำหนด โดยเวลลิออสไม่ต้องรับผิดชอบในความเสียหายใด ๆ ที่เกิดขึ้นก่อนกระบวนการเปลี่ยนแปลง ระงับ หรือยกเลิกดังกล่าวจะมีผลสมบูรณ์
9. การละเมิดข้อตกลงและเงื่อนไขการใช้งาน
ในกรณีที่มีการละเมิดข้อตกลงและเงื่อนไขการใช้งานนี้ เวลลิออสสงวนสิทธิ์ที่จะระงับการเข้าถึงหรือยกเลิกการให้บริการใด ๆ ที่มีขึ้นบนแอปพลิเคชันนี้และ/หรือบริการของเวลลิออสทั้งนี้ การระงับหรือยกเลิกดังกล่าวไม่ถือเป็นการตัดสิทธิเวลลิออสที่จะได้รับการเยียวยาตามข้อตกลงและเงื่อนไขการใช้งานนี้ รวมถึงสิทธิอื่นใดตามกฎหมายที่เกี่ยวข้อง
10. กฎหมายที่บังคับใช้
ข้อตกลงและเงื่อนไขการใช้งานแอปพลิเคชันนี้อยู่ภายใต้การบังคับและตีความตามกฎหมายไทย และศาลไทยเป็นผู้มีอำนาจในการพิจารณาข้อพิพาทใดที่อาจเกิดขึ้น
SiPHPlayPoint Terms and Conditions of Use
Definition:
"Application" means the SiPHPlayPoint application and/or any other application in which Wellios is a service provider and/or another name application that Wellios develops or customizes both pc versions and mobile versions, as well as other electronic devices (mobile version).
"Wellios Services" means an application and website that has deposited a website to a web hosting system where the web address may or may not appear as part of the URL of SiPHPlayPoint.co
"Wellios" means Wellios Co., Ltd.
"Shared Service Provider" means a company, application, platform or website connected to system of Wellios for providing services to users.
"User" means a user of the Wellios Application and/or Service.
"User Affiliation" means the company, organization, agency in which the user is an employee.
"Terms and Conditions of Use" means the Terms and Conditions of Use of Wellios applications and services, which mean, but are not limited to mobile application, tablets or other electronic devices and are applicable to Wellios applications and services which has changed, revised, updated or been added by Wellios. This is excepted Wellios application or service which have changed, revised, updated or been added by Wellios, are specifically defined as subject in terms and conditions of use that differ from these Terms and Conditions of Use.
1. General Agreement
The User acknowledges and agrees that these Terms and Conditions are intended to apply to the Use of Wellios services, including the use of goods and services, access and use content, features, technologies or other functions of Wellios. Also including all applications and services related to the Wellios services and other services connected in this application, both currently available and where Wellios will develop or provide it in the future. Wellios therefore asks users to read and understand the details of these Terms and Conditions in detail before pressing the 'Accept' button to accept these Terms and Conditions of Use
2. Use of applications and intellectual property
2.1 The User acknowledges and agrees to comply with the law. The relevant rules and regulations, both in effect at present and that will be amended or added in the future, as well as the terms and conditions of use, the service policy, in which Wellios are both generally defined and specifically defined in any part of this application and that are defined on the websites that have been deposited on our systems. (if any) (hereinafter referred to all and shall be considered as part of the "Terms and Conditions of Use"). The User acknowledges and agrees that all terms and conditions of use can be changed in accordance with the service guidelines and rules of the law that have been changed. Therefore, users should always monitor these terms and conditions of use. However, Wellios may take the action as suitable to publish changes to the Terms and Conditions of Use after access to this application or the Wellios services, and in the event of all changes we will do our utmost to inform the User and to facilitate you as an existing user. Once the User has accessed this application and/or the Wellios service after such changes, the User agrees to all Terms and Conditions of Use as changed. If the User disagrees with the implementation of the preceding paragraph, including the details contained in these Terms and Conditions of Use, the users can terminate their use and can ask Wellios to delete information about the user or take steps to exercise any other rights as the owner of personal data. Under the rules of the law and defined in the Privacy Policy, users can learn more from the "Privacy Policy" as part of these Terms and Conditions of Use.
2.2 The User accepts and agrees that the use of Wellios Services shall be used with the Internet, mobile networks, devices, software, platforms and/or other related services from such business providers, which users must provide so that users can install, access and use Wellios services and/or content with the user's own expense and the user is obliged to comply with the terms of such service providers for using such services. Therefore, access and use of Wellios service may be some other factors beyond the control of Wellios which might affect to the quality and availability of Wellios applications and/or services. So Wellios cannot guarantee the quality of use.
2.3 Wellios reserves the right to change or cancel the provision of such applications in whole or in part and may consider charging charges for the use of this Application under any circumstances in the future. The system will be notified in advance.
2.4 Information that appears in the Wellios Services have been included, but is not limited to, text, images, videos, data tables, graphs, trademarks, graphics, audio, application screen design, design of user interfaces, information, regardless of format of any software program contained in this application, including any information that users have downloaded from this Application (if any) (hereinafter referred to as "Content"), is the right of Wellios or licensor to Wellios (as the case may be), in which they are protected by intellectual property and/or other ownership rights in accordance with the laws of Thailand and/or the laws of any other country in any form and whether they are registered or not. However, by using logos, trade names, trademarks, service marks and other marks of Wellios, including any intellectual property appearing in this application, for any purpose, the User shall obtain Wellios' prior written consent prior to processing.
2.5 Trade names, product names, trademarks, service marks and other marks, including any other intellectual property that appears in this Application; In addition to what is a Wellios intellectual property, which has been compiled or arranged for use as a component of Wellios services. Wellios, as an application provider, does not intend to commit any act in violation of any person's commercial or intellectual property rights.
2.6 Unless otherwise stated in the Wellios Services, any contents, files or documents that appear in this Application and/or other relevant Wellios services; Users have the right to view, download, upload content and print out only for personal use and not for commercial use. The User agrees not to copy or store or download any contents, either in the form of documents or in any other electronic media format intended for submission, transfer, publish print, reproduce, modify, create new revision, displayed, distributed, authorized, rented, leased, or transferred to the third parties, whether such actions are for commercial benefit or benefit in any other way, unless given prior written consent from Wellios prior to processing.
3. Disclaimer and Limitation of Liability
3.1 Wellios Services are intended to be published, informed and are instrumental to facilitate access to the services of co-providers only. Wellios does not direct or comment, nor does it provide any advice on the purchase, sale, exchange, switching, investment, or transaction of the service providers appearing in this Application. It does not constitute a commitment in a manner represented by the User and shall not be deemed to be relevant to any transaction between the User and the Service Provider to the User that occurs directly or as a result of access to this Application and/or the Wellios Service. In making a decision, Users should learn more about the service descriptions, payment of services and products of co-providers, including terms and conditions of use, as well as regulations related to the access of Wellios services.
3.2 Content and information displayed or appeared in Wellios applications and/or services; Presented in accordance with the condition of the content and information provided by the third party Service Provider, Wellios cannot directly or indirectly warrant, whether it is a guarantee of integrity, accuracy, appropriateness, up-to-date or reliability of content and information or guarantees of the consequences of using or accessing the Wellios Services. Wellios is not responsible for any loss or damage caused by the use of the Application and/or the use of the data content contained in the Wellios Service in any case.
3.3 Wellios will take appropriate action to provide continuous access and use of this Application. It will provide a system to prevent access to any data from non-users. However, Wellios cannot guarantee that access to Wellios services will be without any delays and errors and cannot guarantee that Wellios services will be without the program. Files or software intended to harm or may damage the user's system or system information, such as computer viruses, worms, spyware, trojan horse and other dangerous files (conclusion as “Defect”). Whether such defects are caused by a person or technical failures or other force majeure, the User acknowledges such conditions and agrees that in the event of any defect, Wellios is not responsible for the loss, damage, any claims, expenses, or damages arising out of or consequential to those defects in any case.
3.4 Wellios reserves the right to consider not allowing users to use this Application, including reserves the right to change or suspend access to Wellios Services in part or in whole and at any time to the User without prior notice or reason for that action.
3.5 Wellios cannot guarantee that any ads on this Application and/or the Wellios Services (if any), are accurate, complete and flaw-free. Wellios is only a portal for the transmission of advertising information and is not an agent, any partnership or forensic relationship with the ad owner appearing on the Wellios Services and cannot verify or know the source and/or details of all advertisements appearing on the Wellios Services. However, the presentation of such advertisements causes loss or damage to the user which will be make any further damage. Wellios would not therefore be liable for any loss or damage caused to the User due to the trust or consent to comply with such advertisements and disclaim liability and legal obligations in all cases.
3.6 Other than those set forth in these Terms and Conditions of Use; managers, executives, employees, agents or consultants of Wellios shall not be liable for any errors or defects from The Wellios Services, or based on information, content appearing in Wellios Services, as well as not liable for the consequences of any action or refrain from any acts relating to Wellios Services, whether due to contracts, violations, negligence or any otherwise that may arise. Although Wellios has been notified that such damage may occur, except if the damage was caused by gross deliberation or negligence of Wellios itself.
4. Data linking and websites
This application may be linked to functions, features, or other platforms or websites, including the third-party products and services (the "Linked Website"). This link is intended to facilitate users only. This linked website does not represent support or responsibility or under control of Wellios, so Wellios cannot provide authentication, reliabilities, or security of the linked website. And there will be no liability for any loss or damage suffered by the User for using or linked websites. The User is requested to study the terms and conditions of use of the linked website.
5. Part-specific Terms of Use
The User acknowledges and agrees that Wellios has the right to delete the post, topics, messages, or to suspense user discussion boards (if any) in whole or in part As Wellios considers appropriate, without the need to inform or clarify the reasons to the User under any circumstances.
6. Privacy Policy
The User acknowledges and agrees that the collection, use and disclosure of the User's Personal Data by Wellios for the use of this Application and/or the Wellios Service is protected under the Privacy Policy.
7. Application Security Policy
Wellios has opted for technology, security measures to transact on the Internet to protect users' data during transmission over a communications network or from theft by any unauthorized person or network connected to a Wellios network, such as Firewall and Transport Layer Security Encryption (TLS), etc.
8. Username and Password
8.1 Unless the user receives a username, password, and secret code (PIN) for using in the application. The User must be an employee under the company of User or affiliated with the User allowed. The user's affiliation will issue both username, password, and secret code (PIN) (if any) to the user. Users must keep their identity and password confidential. Accessing and making any transactions arising from login with the user's identity and password in this application shall be deemed to be complete and the user's own actions. If any damage is caused, for any reason, the User shall be responsible for doing so in all respects, and the User agrees not to dispute or demand that Wellios be held accountable for indemnity on behalf of the User in all cases.
8.2 The User acknowledges and agrees that the User may change, suspend or cancel the username, password or secret code (PIN) and/or use of the service of this Application at any time in person through various channels according to the terms and procedures specified by the User. In doing so, Wellios is not responsible for any damages committed before such process of change, suspension or cancellation will take effect.
9. Violation of terms and conditions of use
In the event of a violation of these Terms and Conditions of Use Wellios reserves the right to suspend any access or cancel any services available on this Application and/or the Wellios Services. Such suspension or cancellation does not disqualify Wellios rights to receive a remedy in accordance with these Terms and Conditions of Use, as well as any other rights under applicable law.
10. Applicable Laws
The terms and conditions of use of this Application are governed and construed in accordance with Thai law, and the Thai courts have the authority to consider any disputes that may arise.
